At the proposal of the Minister of Agriculture and Environment, on March 23, 2026, Deputy Prime Minister Tran Hong Ha signed and issued Decree No. 83/2026/ND-CP dated March 23, 2026. This is a pivotal document amending and supplementing several articles of Decree No. 06/2022/ND-CP dated January 7, 2022, regarding the mitigation of greenhouse gas emissions and protection of the ozone layer (as previously amended by Decree No. 119/2025/ND-CP dated June 9, 2025). The core adjustments focus on simplifying the management of ozone-depleting substances while optimizing the timeline for quota allocation.
Simplifying Registration Dossiers and Procedures
The new Decree introduces notable adjustments to the composition of registration dossiers for controlled substances (such as HCFCs, HFCs), facilitating business operations. According to the amended Clause 3, Article 24:
- Leveraging National Databases: Organizations are not required to submit copies of legal entity status documents if such information is accessible via the National Business Registration Database or other specialized databases.
- Significant Reduction in Response Time: Within 02 working days of receipt, the Ministry of Agriculture and Environment must notify the applicant of the dossier’s validity.
- Public Information: Registration results will be published on the Administrative Procedure Resolution Information System and the Ministry’s Portal within 05 working days of receiving a valid dossier.
Quota Allocation and Adjustment Process
Decree No. 83/2026/ND-CP dated March 23, 2026 significantly shortens the processing time for the allocation and adjustment of production and import quotas:
- The review period is reduced from 30 days to 22 working days. This includes reviewing reports, aligning with national targets, and consulting with the Ministry of Industry and Trade.
- Quota Adjustments: Organizations seeking to adjust or supplement quotas must submit requests before July 10th annually, with a maximum review period of 22 working days.
- Result Notification: Regulatory authorities will notify organizations of quota decisions via the online system within 02 working days after the decision is issued
Updated Standardized Forms
This Decree replaces several key forms in Appendix VI of Decree No. 06/2022/ND-CP dated January 7, 2022, including:
- Form No. 01: Registration form for the use of controlled substances.
- Form No. 02: Report on the status of controlled substance usage.
- Form No. 04: Application for quota adjustment or supplementation.
Effectiveness and Transitional Provisions
Decree No. 83/2026/ND-CP dated March 23, 2026 officially took effect on its signing date. To ensure business continuity, dossiers received by the Ministry of Agriculture and Environment before this effective date do not need to be resubmitted and will be processed under the latest regulations.
